Website Terms of Use

By accessing or using this website, you agree to these Terms of Use (“Terms”). These Terms apply only to use of the website and general online content made available by HeroHouse Pediatrics, LLC (the “Practice”). Patient care, telehealth services, consent to treatment, membership, fees, billing, refunds, communications, privacy rights, and termination of services are governed by the Practice’s separate patient-facing documents, including the Practice Policies and Membership Agreement (“Patient Agreement”), general consent to treat, applicable policies, and Notice of Privacy Practices. If there is any conflict between these Terms and a signed Patient Agreement or other policies, the signed patient agreement controls with respect to patient care and services.

This is not an emergency service. If your child is experiencing a medical emergency including difficulty breathing, severe pain, uncontrolled bleeding, loss of consciousness, seizures, or any life-threatening situation, call 911 immediately or go to the nearest emergency room. Do not wait for a telehealth visit.

1. Website Information Only

The information on this website is provided for general informational purposes only. Website content does not constitute medical advice, diagnosis, treatment, or a recommendation for any specific service, medication, or course of care.

Browsing this website, submitting a general inquiry, or reviewing online content does not create a provider-patient relationship. A provider-patient relationship is established only when the Practice accepts the patient for services and the Provider agrees to provide care in connection with a telehealth visit or other clinical encounter.

Do not use general website forms, public online channels, social media, or unsecured email to submit urgent clinical information or protected health information unless the Practice specifically instructs you to do so.

2. No Emergency Services

The Practice does not provide emergency care through the website, patient portal, telehealth visits, messaging, email, or social media. The Practice does not guarantee immediate availability or response.

If you believe the patient may be experiencing a medical emergency or needs immediate care, call 911 or go to the nearest emergency department. Do not wait for a response from the Practice or use the website or telehealth services in place of emergency care.

3. Services, Eligibility, and Patient Documents

The Practice provides telehealth-based pediatric services by Jesse Jones, MSN, APRN, CPNP-PC (the “Provider”) only as described in the Practice’s patient-facing documents. Eligibility, age limitations, state licensure requirements, scope of services, triage procedures, clinical limitations, parent or guardian participation requirements, and escalation procedures are governed by the Patient Agreement, general consent to treat, and related policies.

Nothing on the website should be understood as a promise that telehealth is appropriate for any particular condition or that any specific service, prescription, referral, test, or outcome will be provided.

You must complete all required forms and consents before receiving services. The Practice may decline, reschedule, or redirect a request for care when telehealth is not appropriate, required information is incomplete, or applicable requirements are not met.

4. Scheduling, Membership, Fees, and Refunds

Scheduling, membership options, billing cycles, included services, fees, payment authorization, cancellation policies, refunds, no-shows, late cancellations, and Good Faith Estimate rights are governed by the Patient Agreement, applicable fee schedule, refund and cancellation policy, and related documents.

5. Communications and Portal Use

Clinical communications should occur only through the Practice’s designated secure channels, such as the patient portal, unless the Practice instructs otherwise. General website forms, unsecured email, social media, and public online review platforms are not appropriate for urgent medical issues, protected health information, or patient-specific clinical questions.

6. Website Use Restrictions

You agree not to use the website to attempt unauthorized access, interfere with website operations, scrape or harvest information, submit false or misleading information, impersonate another person, upload malicious code, or use the website in a manner that violates applicable law or Practice policies.

7. Third-Party Platforms

The Practice may use third-party platforms for scheduling, payment processing, telehealth visits, electronic health records, forms, messaging, website hosting, analytics, or other administrative functions. Your use of those platforms may also be subject to the applicable vendor’s terms, privacy practices, and technical requirements.

8. Privacy

The Practice is committed to protecting the privacy of patients, families, and website visitors. The Practice’s separate Notice of Privacy Practices governs uses and disclosures of Protected Health Information. Website data practices, if described separately, do not replace the Notice of Privacy Practices.

9. Disclaimers; Website Availability; Limitation of Liability

The website and online content are provided on an “as is” and “as available” basis. The Practice does not guarantee that the website, portal links, scheduling tools, payment tools, or other online features will be uninterrupted, error-free, secure, or available at all times.

To the fullest extent permitted by law, the Practice shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from website use, online content, or non-clinical online features. These limitations apply to website use and non-clinical online services only and do not limit any rights or remedies that cannot be limited under applicable law or that arise from professional clinical care provided by the Practice.

10. Governing Law

These Terms are governed by the laws of the State of Indiana. Any disputes arising from these Terms or use of the website shall be resolved in the courts of Indiana, except to the extent another forum is required by applicable law.

11. Changes to These Terms

The Practice may update these Terms periodically. Updated Terms will be posted with a revised effective date. Continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms.
